Lucent Branding ("we," "us," or "our") is a solo web design and digital product service operated by Deepali Rana, based in India. These terms govern your use of our website (the "Site"), custom web design services, and digital products like website templates (collectively, "Services"). By accessing the Site or engaging Services, you agree to these terms. If you do not agree, do not use the Site or Services. We serve international clients, but as an India-based business, all agreements are under Indian law for clarity and consistency.

1. Terms of Service
Eligibility
You must be at least 18 years old and legally able to contract to use our Services. We may refuse service to anyone for any reason.
Services Description
We offer:
Custom Web Design Packages:
Set Up Package (for new businesses): Includes Brand Identity, Wordmark Logo, Template Responsive Website, Contact Form Integration, Website Copy Template, Training on Content Updates, SEO Optimization. Starting at 1700 USD; 5 days to 1 week.
Set Out Package (for established businesses): Includes Brand Strategy, Marketing Strategy, Brand Identity, Competitor Research & Audience Analysis, Customized Responsive Web Design (Mobile-Optimized), Web Development in Framer, Sales Page/Website Copywriting, SEO Optimization, 2 Revisions, 3 Months Post-Launch Assistance. Starting at 4900 USD; 4 weeks to 1 month.
Digital Products (Website Templates): Pre-designed website templates delivered via download. Single-use, non-transferable license; no modifications or resale permitted. No support unless specified.
Prices (as of June 6, 2024; updated with projects/testimonials) and details are in a separate project agreement or product listing ("Project Agreement"). If conflicting, the Project Agreement controls.
Payments
Custom Services: Paid in two installments: 50% non-refundable deposit before work begins, 50% upon completion/approval. No work starts until the deposit clears.
Templates: Full payment upfront; delivered post-payment.
General: Processed via Razorpay (terms at https://razorpay.com/terms/). International clients may face fees (e.g., 3% transaction, currency conversion). Payments in USD/INR as agreed; we store no payment data—Razorpay handles securely. Late payments incur 1.5% monthly interest. Prices exclude taxes; international services are zero-rated exports (no GST). You’re responsible for local taxes (e.g., VAT). We’re not liable for gateway issues or client-side fees.

Client Responsibilities
For custom services, provide accurate materials and timely feedback. You warrant materials don’t infringe third-party rights (e.g., copyrights). Delays may extend timelines or add fees. For templates, you’re responsible for proper use/installation.
Intellectual Property
Templates: You receive a single-use, non-transferable license to use as-is for one website. No resale, modification, or distribution. We retain all IP rights.
Custom Services: We retain ownership of tools/code. Upon full payment, final deliverables transfer to you. We may use projects in our portfolio.
Revisions and Changes
Custom services: Revisions per package (e.g., 2 for Set Out); extras cost more. Templates: No revisions.
Termination
Either party may terminate custom projects with written notice. Work may be paused for unforeseen circumstances (e.g., client delays, emergencies, or external events like technical failures). If you fail to cooperate or respond (e.g., ghosting), we send 3 warning emails over 16 days; if no response, the project terminates, and no refunds are issued. For custom projects, you may request work completed up to termination (e.g., designs, code) within 30 days, provided as-is with a non-commercial, non-transferable license, at our discretion. No deliverables for minimal work or templates. You pay for completed work.
No Warranties
Services/templates are "as is" without warranties, including merchantability, fitness, or non-infringement. No guarantee of error-free sites, compatibility, or results.
Limitation of Liability
We’re not liable for indirect, incidental, special, or consequential damages (e.g., lost profits), even if advised. Liability capped at fees paid for the specific Service. Not liable for third-party issues (e.g., Razorpay, Framer). Applies to fullest extent of law.
Indemnification
You agree to cover any losses, damages, or legal costs we face due to claims arising from materials you provide (e.g., copyrighted content) or your use of Services.
Force Majeure
No liability for delays from uncontrollable events (e.g., disasters, technical failures).
Governing Law and Disputes
As an India-based business, we use Indian law to ensure clear, consistent agreements. Disputes are resolved first via good-faith negotiation, then mediation, then exclusively in Delhi, India courts. By using our Services, you consent to this jurisdiction, waiving objections, regardless of your location (e.g., US/UK).
Changes
We may update these terms; continued use accepts changes. Check periodically.
2. Privacy Policy
We protect data under India’s DPDP Act 2023 and align with GDPR (EU) and CCPA (California).
Information Collected
Forms/Calls: Name, email, phone, business details (e.g., website, goals) via discovery form.
Usage Data: Basic Framer analytics (e.g., visits, no identifiers) and Google Analytics to collect anonymized usage data, including IP addresses (anonymized where possible), device information, browser type, pages visited, time spent on the Site, and referral sources. This helps us understand Site performance and user behavior. Google Analytics may use cookies or similar technologies (e.g., first-party cookies for session tracking) to collect this data. You can opt out of Google Analytics tracking via browser settings, our cookie banner, or tools like Google Analytics Opt-out Browser Add-on (available at https://tools.google.com/dlpage/gaoptout). We do not collect or store personally identifiable information through Google Analytics without your explicit consent.
Payment Data: Handled by Razorpay; Wise; PayPal we store none.
No data from under 18s or sensitive data unless needed.
How We Use It
Deliver/improve Services.
Communicate (e.g., support, updates).
Process payments.
Analyze Site usage via Google Analytics to optimize user experience, track trends, and inform Service improvements (e.g., popular pages or drop-off points). Data is aggregated and anonymized; we do not use it for targeted advertising.
Comply with laws.
Sharing
Only with:
Providers (Razorpay for payments, Framer for analytics/hosting), Google LLC for Google Analytics processing—data is transferred to Google servers in the US under standard contractual clauses for GDPR compliance and equivalent safeguards under DPDP Act).
As legally required.
International transfers use safeguards (e.g., GDPR clauses). No selling/sharing for ads.
Your Rights
Per DPDP/GDPR/CCPA:
Access, correct, delete data.
Withdraw consent.
GDPR: Request portability.
CCPA: No data selling.
For Google Analytics data: You may request deletion of associated usage data by contacting us; we will instruct Google to anonymize or delete it where feasible. Opt-out options are available as noted above. Cookie preferences are managed via our on-site banner; declining non-essential cookies prevents Google Analytics tracking.

Data Security and Retention
Reasonable security (e.g., encryption). Breaches reported per law. Data kept during project + 1 year, then deleted unless required. Google Analytics data is retained per Google's default policies (up to 26 months for standard reports) or as customized by us, and is subject to Google's privacy terms.
Changes to This Policy
We may update this Privacy Policy to reflect changes in our practices, including data handling, security, or retention, or to comply with laws. Updates will be posted on this page, and continued use of our Site or Services constitutes acceptance.
3. Refund Policy
No refunds for custom services or templates. Custom deposits (50%) non-refundable. Work starts only after deposit clears. Projects may pause for unforeseen circumstances (e.g., client delays, emergencies). If you fail to cooperate after 3 warnings over 16 days, the project terminates without refund. For custom projects, you may request work done up to termination (as-is, non-commercial license) within 30 days, at our discretion. No refunds for change of mind, client delays, abandonment, or templates post-delivery. Exceptions only if we fail to deliver per Project Agreement.
